The Associate General Counsel will serve as legal advisor to SCAN Group's Medicare Advantage plans and integrated care delivery organizations, providing practical, business-minded legal advice. Reporting to the Deputy General Counsel, this role is responsible for managing a diverse litigation portfolio, including labor and employment, complex provider, and vendor disputes, as well as support SCAN's vendor contracting and procurement process. The work is varied and complex, requiring a high degree of discretion, flexibility, and independent judgment, and is done with the highest level of ethics and integrity. The successful candidate is an excellent communicator, an enthusiastic and curious learner, and can work autonomously on a variety of assignments and projects in a fast-paced, high-volume environment. The Associate General Counsel should possess a strong drive for excellence, attention to detail, an ability to adapt to change, and a "can do" positive attitude. Extensive experience in complex litigation and dispute resolution is required; prior experience in vendor contracting and a background in managed care or health law is strongly preferred.

The position is hybrid, with on-site days twice per week (currently Tuesdays and Wednesdays) at SCAN's headquarters in Long Beach, California.

The Job

Manages and provides strategic direction on all phases of litigation, including labor and employment, provider reimbursement, vendor disputes, and general liability disputes.

Directly represents SCAN in administrative proceedings and some arbitrations or litigation.

Drafts, reviews, advises, and negotiates a broad range of contracts, including vendors, providers (hospital, primary care, specialist, ancillary providers, telehealth, etc.), payors, and grants.

Conducts internal investigations into compliance, regulatory, employment, and operational matters, including coordinating fact finding, preparing investigative reports, and partnering with outside counsel on investigations.

Performs legal research and provides legal and regulatory counsel on issues relating to health plan and medical group operations, federal and state healthcare laws (e.g., Stark Law, Anti-Kickback Statute, HIPAA, licensing, scope of practice), PACE programs, Medicare, Medicaid, telehealth, etc.

Actively oversees and manages outside counsel, including setting case strategy, reviewing work product, and managing legal spend to ensure cost-effective, high-quality results.

Acts independently to provide well-informed and timely legal advice on a variety of complex and sensitive matters.

Monitors and researches market and industry trends of interest to the organization in connection with its business activities.

Anticipate changes impacting operations, keeps management abreast of developments and recommend preparatory actions.

Works collaboratively with a broad range of stakeholders throughout the organization to develop and maintain strong relationships with SCAN business units and affiliates.

Your Qualifications

  • Juris Doctor from a top-tier, ABA-accredited law school.
  • Active membership in good standing with the California State Bar, or eligibility to practice as Registered In-House Counsel (RIHC).
  • Minimum 8 years of relevant legal experience, which may be a combination of top-tier firm and in-house at an established legal department.
  • Substantial civil litigation, including arbitration and administrative proceedings, is required.
  • Ability to directly represent SCAN in administrative hearings and smaller litigation and arbitrations.
  • Experience negotiating, drafting, and interpreting complex vendor contracts preferred.
  • Knowledge of federal and state healthcare law related to managed care, Medicare Advantage, HIPAA, Fraud Waste and Abuse (e.g., Stark, Anti-Kickback Statute) preferred.
  • Strong organizational skills; ability to multitask.
  • Strong analytical and critical thinking skills required.
  • The ability to collaborate as team player and to adapt to change, master new skills, and assume additional responsibilities as needed.
  • Personal and professional demeanor needed to work with all levels of individuals throughout the organization.
  • Practical and business oriented with sound judgment and the ability to work well in a fast-paced team environment. Able to balance competing priorities.
