Overview

Summary:
This position directly reports to the EVP of the Litigation Department. In this role, you will assist with reinsurance issues, extra-contractual matters specific to workers' compensation and general liability, and suits filed against the Company. Candidates should have reinsurance and/or workers' compensation litigation experience. This role provides technical leadership to the Litigation Department for all procedural and substantive issues involving workers' compensation relative to direct insurance, reinsurance, runoff lines of business, and regulatory decision making. You will develop and implement various Litigation Department missions and objectives, including litigation best practices, optimization of litigation management and strategy decisions, mitigation and elimination of behaviors that might give rise to extra-contractual exposure, all consistent with the best interests of AmTrust insureds. Maintain understanding of AmTrust's mission, vision, and values. Uphold the standards of the AmTrust organization.

Responsibilities

Responsibilities:

    Analyze issues concerning ceded reinsurance, including appropriate cessions of complex claims and construction and interpretation of reinsurance contracts with respect to ceded claims and billing/collection consequences.
  1. Support the Litigation Department's extra-contractual practice group in addressing all workers' compensation matters.
  2. Assist in runoff strategy and direct handling of Public Entity runoff book for both workers' compensation and general liability claims.
  3. Recognize, communicate, and monitor legal trends related to the workers' compensation business lines. Identify opportunities for technical coverage and legal training.
  4. Drive technical excellence for the Litigation Department by assisting with various litigation tasks such as: litigation holds; discovery responses in suits involving the Company; deposition preparation for Company witnesses (current and former employees); affidavits of company personnel; confidentiality/protective orders to maintain the propriety of Company records, practices, trade secrets, etc.
  5. Partner with senior management to plan strategic initiatives that improve the Litigation Department's development, performance, and goal achievement.
  6. Serve as a mentor and share in the responsibility of supporting and developing others within the Litigation Department.
  7. Represent the Litigation Department to support large projects in other business unit.
  8. Performs other functionally related duties as assigned.
  9. Develop/maintain strong relationships with business partners.


Qualifications

Qualifications:
Required:

  • Juris Doctor from accredited law school
  • CA Bar certification/licensing and good standing with appropriate state Bar
  • 15 years' experience in legal and/or litigation capacity within insurance company or private practice in a high-volume, nationwide litigation environment
  • Experience with data analytics
  • Ability to effectively communicate complex matters to executive management.

Preferred:

  • leadership experience
  • legal analysis, strategy, and technical experience in workers' compensation, general liability, and/or reinsurance.
  • insurance organization experience
