Salary offers are based on the candidate's equivalent experience and internal equity with other employees within the same job classification. The position is not eligible for overtime compensation for all hours worked over 40 in the designated workweek.

About the Position

The Civil Services Division of the Maricopa County Attorney's Office serves as a law firm that provides legal representation and advice to Maricopa County, its various elected officials and agencies, as well as the dedicated employees of Maricopa County. Our division has four practice groups: Litigation, Governmental Advice, Human Resources/Behavioral Health, and Appeals/Elections. The Litigation Practice Group consists of attorneys, paralegals, and administrative assistants who work in a collaborative environment to defend legal actions, lawsuits, and claims brought against the County and its various agencies, elected officials, and employees. The group also represents Maricopa County in environmental and zoning enforcement claims and condemnation matters.

The current recruitment is for a senior-level attorney position within the Litigation Practice Group. The main focus of this senior-level position involves representing Maricopa County, its agencies and elected officials, and employees in all levels of litigation in State and Federal Courts.The senior litigator will be responsible for handling a variety of cases, including state law tort claims (e.g., trip and fall, car accidents, or road design cases); 42 U.S.C. * 1983 claims of deliberate indifference, excessive force, and wrongful death; and, when needed, environmental and zoning enforcement matters. The senior litigator will be entrusted to lead a litigation team while handling those cases, directing the course of the defense of the litigation, as well as working closely with the clients and adjustors in Maricopa County Risk Management to bring about a successful resolution, including taking the case to trial if necessary.

We Require

  • Juris Doctorate from an ABA-accredited law school

  • Five years of experience in civil litigation with experience litigating cases in state and federal court, as well as state and federal appeals courts

  • Successful candidates must be admitted to practice law and be in good standing with the State Bar of Arizona at the time of application

  • Valid Arizona driver's license upon hire

  • Experience in mentoring and training less experienced attorneys, paralegals, and legal assistants

  • Experience in condemnation matters is a plus, but not a requirement for this position

Job Contributions

  • Perform complex legal work and analysis as it pertains to various litigation matters, including complex civil rights litigation

  • Conduct research and analyze legal issues using both computerized legal research and hard copy tools

  • Responsible for defending a broad spectrum of civil claims as assigned by the Practice Group Leader, including civil rights, torts, and other claims

  • When needed, assist the Civil Division with appeals work, including writing and editing appellate court briefs, defending clients at oral argument when scheduled, and assisting other attorneys in the office in preparing appeals and arguments

  • Develop client discussions and negotiations as it pertains to the various issues in assigned cases, including representing clients in private and court-appointed mediations and settlement conferences

  • Work closely and collaboratively with other attorneys, paralegals, and legal assistants in the office, as well as clients and adjustors in evaluating and defending assigned cases.

  • Attend court to defend the client at status conferences, oral arguments, evidentiary and other hearings as set by the Court, and at trial

  • Provide litigation risk analyses and status reports to the Practice Group Lead and, where appropriate, to the Maricopa County Board of Supervisors, the Maricopa County Self-Insured Trust Fund Board of Trustees, the Maricopa County Risk Manager, and clients

  • Assist with supervising and mentoring non-senior attorneys as needed

  • Responsible for compliance with the continuing legal education requirements and other requirements imposed by the State Bar of Arizona
